This policy describes Indigenus’ practices regarding the privacy of our Site’s users’ information. 

Information Collected

Indigenus shall only collect personally identifiable information to the extent reasonably necessary for legitimate business purposes. Indigenus may collect:

How the Information is Used and External Distribution

Distribution to Third Parties of Personally Identifiable Information and of Confidential Information

External distribution does not include certain limited distributions such as sharing personally identifiable information with a third party working on behalf of Indigenus, transfer of personally identifiable information in connection with the sale of Indigenus assets or the merger or acquisition of Indigenus or the disclosure of personally identifiable information in connection with legal proceedings, investigations of crimes, or other governmental investigations. Transferring personally identifiable information in connection with a sale, merger or acquisition and sharing personally identifiable information with an entity or person working on behalf of Indigenus is considered an onward transfer to third parties and is permitted under this policy. 

Use of Cookies

Indigenus uses “cookies”. “Cookies” are elements of data that a Web site can send to a user’s browser and store on a user’s computer. Cookies can note that a user’s browser was used to visit certain sites or pages on a certain date. Indigenus uses cookies to enhance navigation and functionality of the Site. Indigenus also uses cookies to let it know how visitors are using the Site, so that it can improve the Site and a user’s experience on it. 

Disclosure

You acknowledge and agree that Indigenus may preserve or disclose any personally identifiable information if it reasonably believes disclosure is required by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, including but not limited to civil and criminal subpoenas, court orders or other compulsory disclosures; (b) enforce the Privacy Policy and Terms and Conditions; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property or personal safety of Indigenus, its members, users and the public.

The Site may provide links to Web sites of third parties including, without limitation, entities that have an ownership interest in Indigenus. Indigenus is not responsible or liable for the privacy practices of these other sites.

Access, Review and Correction

Users can, by e-mailing Indigenus at or by writing to Alan Posner at Indigenus Network, LLC, 641 6th Avenue, 5th Floor, New York, NY 10011, review and correct the personally identifiable information that has been collected from them by Indigenus.

Binding Agreement and Changes 

Any user that accesses all or any part of the Site agrees that such user is at least 18 years old and has agreed to this Privacy Policy. Each time a user accesses the Site, this Privacy Policy should be reviewed because Indigenus reserves the right to change this Privacy Policy from time to time and the revised Privacy Policy shall become effective and govern the use of the Site within five days of such revised Privacy Policy being initially posted on the Site.

 

By accessing the Site, you agree that any dispute with respect to privacy is subject to this Privacy Policy and the Terms and Conditions of the Site. Any claim arising out of or relating to this Privacy Policy or the privacy of users’ information shall be governed by the laws of the State of New York, U.S.A, without giving effect to any conflicts of laws provisions. You agree that in the event of any dispute or claim with respect to this Privacy Policy or any privacy issues, the sole and exclusive jurisdiction for bringing any such action shall be the Borough of Manhattan in the City of New York in the State of New York, U.S.A., and you waive any claim of inconvenient forum. 

Effective Date

This Privacy Policy is effective as of March 1, 2011.
